1) Read this first โ€” no emergencies

Haven OBGYN's website and digital properties (the "Site") are not appropriate for emergency care or urgent situations. If you are experiencing a medical emergency, call 911 immediately. Nothing on this Site should delay or replace seeking care in an emergency.

2) Acceptance of these Terms

These Website Terms of Use ("Terms") are a binding agreement between you ("you," "your," or the "User") and Haven OBGYN ("Haven," "we," "us," or "our") and govern your access to and use of the Site, including any content, tools, and features offered on or through it (collectively, the "Services"). By accessing or using the Services, clicking "I agree," or using any other acceptance mechanism presented, you confirm that you are at least 18 years old and agree to be bound by these Terms and our Website Privacy Policy.

3) Who we are (and what this Site is not)

Haven is a physician-led medical practice located at 1600 Creekside Drive, Folsom, CA. The Site helps you learn about our practice, request appointments, and access educational resources. While Haven delivers clinical care through licensed professionals, the content on the Site itself is informational only and is not medical advice. Always seek the advice of a qualified clinician for diagnosis and treatment questions; never disregard professional advice because of something you read on this Site.

4) Relationship with digital tools (e.g., patient portal, ZIA assistant)

From time to time, you may access third-party tools through links on this Site (for example, the Epic/Hill Chart patient portal for secure messaging and telehealth, or an AI-driven assistant that offers education and care navigation). Those tools are provided by separate companies and/or affiliated medical groups; if you use them, their own terms and privacy policies will apply in addition to ours.

5) Not insurance

Nothing on the Site constitutes health insurance, and fees you pay for digital tools or membership-like services (if ever offered) are not insurance premiums.

6) Eligibility; U.S. use only

The Site is intended for adults 18+ located in the United States. You may not use the Site if you are under 18 or located outside the U.S. You are responsible for complying with all laws that apply to your use of the Services.

7) Privacy

Your use of the Site is also subject to our Website Privacy Policy (effective Nov 1, 2025). Please review it for details on how we collect, use, and protect information submitted through forms or other Site features. If you connect to external portals or tools (e.g., Epic/Hill Chart), those services have their own privacy notices.

8) Electronic communications & consent

When you contact us through the Site, submit forms, or provide contact information, you consent to receive electronic communications from Haven, such as emails, text messages (SMS/MMS), phone calls (including automated or prerecorded), and portal messages. Electronic communications satisfy any requirement that communications be in writing. Message and data rates may apply; message frequency may vary; reply STOP to opt out of texts and HELP for help. 9) Accounts, passwords, and security

If parts of the Services require an account, you must keep your credentials confidential and are responsible for all activity under your account. Notify us promptly of any unauthorized use or security concerns. Similar protected-area and credential responsibilities are standard for health platforms.

10) Acceptable use

You agree not to: (a) use the Services for any unlawful purpose; (b) scrape, copy, or extract non-public content; (c) attempt to reverse engineer non-public components; (d) circumvent security measures; (e) impose unreasonable load on our infrastructure; (f) run auto-responders, bots, or spam; (g) impersonate others; or (h) otherwise violate these Terms. These typical restrictions protect the integrity and availability of healthcare websites.

11) Intellectual property

All content on the Site (text, graphics, logos, images, video, design, and compilations) is owned by Haven or our licensors and is protected by U.S. and international IP laws. You may not reproduce, distribute, modify, frame, or create derivative works without our prior written consent. Branding and ownership language of this type is standard and aligns with similar terms used by digital health platforms.

12) Third-party links and tools

The Site may link to third-party websites, apps, or services (e.g., patient portals, labs, payers, Microsoft forms, or the ZIA assistant). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party tools is at your own risk and governed by those third parties' terms.

13) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent not prohibited by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. Educational content on the Site is provided for general information and is used at your own risk. Similar disclaimers are customary across digital health platforms.

14) Limitation of liability

To the maximum extent allowed by law, in no event will Haven or our clinicians, employees, or agents be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Site. Our total liability for any claim relating to the Services will not exceed the amount you paid (if any) to use the Site in the six (6) months preceding the event giving rise to the claim. This cap mirrors standard health-site terms and protects the sustainability of care delivery.

15) Changes, suspension, and termination

We may update the Site, change features, or suspend/terminate access at any time, with or without notice. Continuing to use the Site after we post changes to these Terms means you accept the updated Terms.

16) Governing law; venue; arbitration; class-action waiver

These Terms and your use of the Site are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing a claim, you agree to try to resolve the dispute informally by sending a written notice describing your claim and desired resolution to contact@haven-obgyn.com (or by mail to our clinic address). If not resolved in 30 days, either party may file in small claims court (individual basis only) or commence binding, individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. You waive any right to a jury trial or to participate in a class action, collective action, or other representative proceeding.

17) California consumer notice

18) Miscellaneous

If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms (and the policies referenced herein) constitute the entire agreement between you and Haven regarding the Site. We may update these Terms at any time by posting a revised version with a new "Effective date."
